Contests
No purchase is necessary to participate in any contest. Contests are void where prohibited or restricted by law or where there are registration or bonding requirements. In order to be eligible, you must meet the eligibility requirements as provided in any contest description page (“Contest Page”). A particular contest will start and end as indicated on Contest Page.
Contest: Judging and Winners
All Contests are contests of skill. A contest is void where any aspect of the contest is prohibited or restricted by law. Odds of winning depend on the skill and number of people participating. A Contest Page will generally indicate judging criteria and the number of winners to be selected. All winners will be selected on an objective basis, and may be based on public voting, selection by ClassDojo (or its designees), or both, as indicated on the Contest Page. Winners may subject to verification, including without limitation, verification of eligibility, compliance with the terms and conditions of the contest, and completion of any required documents. In the event of a tie based on the initial judging criteria, judges may compare the initially tied entries and make a determination of the winner in order to break the tie, or may provide additional prizes in the event of a tie. ClassDojo will attempt to contact or notify potential winner, and ClassDojo reserves the right to select an alternative winner in the event that potential winner fails to respond within the required time period. In the event of a dispute as to the identity of participants or winners, ClassDojo shall make the final determination as to identity. You agree that, as between you and ClassDojo, ClassDojo has the sole right to decide all matters and disputes arising from any contest and that all decisions of ClassDojo related to a contest are final and binding. ClassDojo reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who they suspect has tampered with a contest, the entry or participation process, violated the terms of the Contest Page, or acted in an unsportsmanlike or disruptive manner.
Prizes
The Contest Page will indicate (i) the number of winners and the prizes to be awarded each winner, and (ii) the approximate retail value of each prize awarded and the aggregate approximate value of all prizes. No substitution, assignment or transfer of the prizes is permitted, except by ClassDojo, who has the right to substitute a prize with another of comparable or greater value. Prizes awarded may be subject to third-party terms and conditions.
Requirements
Your contest entry must not contain any third-party material or any identifiable third-party brands. Entries may not contain material that is obscene, defamatory, libelous, threatening, pornographic, racially or ethnically offensive, or that violates any law. Entries may not violate the rights or policies of any third party, including your school or employer, or require that ClassDojo obtain any permission from or make any payment to any third party. Entries must be appropriate for viewing by the general public, as determined by ClassDojo.
Permission to Use your Entry
By participating in a contest, you giveClassDojo a non-exclusive, irrevocable, perpetual, royalty-free, fully paid-up, worldwide, sublicensable, transferable right and license to access, collect, use, copy, store, host, disclose, transmit, transfer, publish, publicly display, modify, create derivative works of, and otherwise process any entry or social media posting in connection with any entry, in any medium and for any purpose. The foregoing license includes the right to use, review, assess, test and otherwise analyze your entry and all its content in connection with the Contest. Except for the prize in the event you are a winner, you will not receive any compensation or credit for ClassDojo’s use or posting of your entry.
Taxes
You are responsible for all taxes and fees associated with the receipt and/or use of any prize. ClassDojo and its designees have the right to withhold payment or awarding of as it believes reasonably necessary for legal compliance, including any tax regulations. You may have to provide a Social Security number or Taxpayer ID prior to the awarding of any prize.
Publicity Release
Each winner may berequired to sign an affidavit of eligibility, liability release and a publicity release that, among other things, will allow ClassDojo to use the winner’s name, photograph, likeness, voice, prize information, and biographical information for publicity and promotional purposes without further compensation where permitted by law. Except where prohibited, participation in a contest constitutes your consent to ClassDojo’s use of your name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration. ClassDojo Information and Representations Unless otherwise stated on a Contest Page, a contest is sponsored by ClassDojo.
Release
YOU HEREBY HOLD CLASSDOJO AND ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, AND AGENTS, ANY SOCIAL MEDIA PLATFORM UTILIZED (E.G., META, X, TIKTOK) AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS AND AGENTS (COLLECTIVELY “RELEASEES”) HARMLESS FROM AND AGAINST ANY THIRD PARTY CLAIM ARISING FROM ENTRY IN A CONTEST, PARTICIPATION IN A CONTEST, OR USE OF ANY PRIZE. RELEASEES ARE NOT RESPONSIBLE FOR LOST, LATE, DAMAGED, MISDIRECTED, ILLEGIBLE, INCOMPLETE, OR MUTILATED ENTRIES, OR FOR ANY COMPUTER, ONLINE, TELEPHONE OR TECHNICAL MALFUNCTIONS, DELAYS OR HUMAN ERRORS THAT OCCUR IN THE PROCESSING, TRANSMISSION OR RECEIPT OF ENTRIES, OR FOR INACCURATE TRANSCRIPTION OF ENTRY INFORMATION, OR FOR ENTRIES THAT ARE MISDIRECTED, GARBLED, LOST OR DELAYED BY COMPUTER TRANSMISSIONS, OR IF FOR ANY REASON, THE CONTEST IS NOT CAPABLE OF BEING CONDUCTED AS PLANNED, INCLUDING BUT NOT LIMITED TO INFECTION BY COMPUTER VIRUSES, BUGS, TAMPERING, UNAUTHORIZED INTERVENTION, FRAUD, TECHNICAL FAILURES, OR OTHER CAUSES BEYOND THE CONTROL OF CLASSDOJO. Non-Affiliation of Social Media Platforms Unless otherwise explicitly stated on a Contest Page, no social media platform (including, without limitation, Meta, Twitter, X, LinkedIn, TikTok) is affiliated with the contest. Required Use of ClassDojo Hashtags in Social Media in Connection with Contests In connection with some contests where various social media actions are required, you must use specific ClassDojo hashtags (as indicated on a Contest Page) to prominently indicate the material connection between you and ClassDojo related to the contest.
General
ClassDojo reserves the right to shorten, extend, modify, or cancel any contest, in its sole discretion, at any time and without notice, even though such action may affect your ability to win a prize. ClassDojo not responsible for any typographical or other error in printing or description of any contest. For a list of any winners, please send a request with the name of the specific contest within three months of the end of such contest to socials@classdojo.com. Submissions For Submissions submitted for any contest, you agree to abide by the terms and conditions of these Terms as well as any additional terms or conditions identified in the specific rules for such contest as listed on a Contest Page.
